These terms govern your use of Birthday Catalog. By visiting the site or creating an account, you agree to them. If you do not agree, please do not use the site.

What We Provide

Birthday Catalog is a free, publicly available directory of birthday freebies, rewards, and promotions offered by third-party restaurants, retailers, and brands. We are an independent directory. We do not provide the offers ourselves, we are not affiliated with the brands listed unless explicitly stated, and we cannot honor, extend, or reinstate any offer.

Eligibility and Accounts

You must be at least 13 years old to use Birthday Catalog, and at least 18 to purchase advertising. You are responsible for the security of your account and for everything that happens under it. Notify us promptly at hello@birthdaycatalog.com if you believe your account has been compromised.

We may suspend or terminate an account that violates these terms, abuses the service, or creates risk for other users.

Accuracy of Listings

Birthday offers change constantly. Brands modify, restrict, or discontinue them without notice, and terms frequently vary by location and franchise. We work to keep listings current, but we make no guarantee that any listing is accurate, complete, or still available.

Always verify an offer directly with the brand before making a trip or a purchase. We are not responsible for a wasted journey, a declined freebie, or a purchase you made in reliance on a listing.

Acceptable Use

You agree not to:

• Scrape, crawl, or bulk-copy the site's content for republication or to build a competing directory
• Submit false, misleading, or spam listings
• Interfere with the site's operation, security, or availability
• Attempt to gain unauthorized access to accounts, systems, or data
• Use the site to violate any law, or to infringe anyone's rights
• Misrepresent your affiliation with a brand or company

Submissions

When you submit a listing, you grant us a non-exclusive, worldwide, royalty-free license to publish, display, edit, and distribute it as part of the directory. You confirm that you have the right to submit it and that it does not infringe anyone's rights. We review submissions and may edit, decline, or remove any listing at our discretion.

Advertising and Payments

Paid placements are billed through Stripe. Advertising fees are non-refundable once a campaign has begun, except where required by law or where we fail to run a campaign you paid for. Advertisers are solely responsible for the accuracy and legality of their creative, and we may decline or remove advertising that is misleading, unlawful, or inconsistent with the site.

Paid placement does not influence editorial listings, and paid advertising is identified as such.

Affiliate Links

Birthday Catalog contains affiliate links and paid advertisements. We may earn a commission or referral bonus when you click through and make a purchase or apply for a product. This costs you nothing and does not affect whether a freebie is listed.

Intellectual Property

The site's design, original written content, and compilation of listings belong to us. All third-party trademarks, logos, and brand names remain the property of their respective owners, and their appearance here does not imply endorsement, affiliation, or sponsorship. Brand representatives seeking a correction or removal can reach us at hello@birthdaycatalog.com.

Third-Party Sites

Our listings link to sites we do not operate. We are not responsible for their content, their offers, or how they handle your data - including the birthday clubs you may join through them. Your dealings with those companies are solely between you and them.

Disclaimer of Warranties

Birthday Catalog is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be uninterrupted, error-free, or that any listing will be accurate.

Limitation of Liability

To the fullest extent permitted by law, Birthday Catalog and its operators are not liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss arising from your use of the site or reliance on any listing. Where liability cannot be excluded, our total liability is limited to the greater of the amount you paid us in the twelve months preceding the claim, or one hundred US dollars ($100).

Indemnification

You agree to indemnify and hold harmless Birthday Catalog and its operators from any claim or demand arising out of your use of the site, your submissions, or your violation of these terms.

Governing Law

These terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from these terms or your use of the site will be brought exclusively in the state or federal courts located in California, and you consent to the jurisdiction of those courts.

Changes to These Terms

We may revise these terms from time to time. When we make a material change, we will update the date below. Continued use of the site after a change constitutes acceptance of the revised terms.
